Before ordering services through Zirux Gaming please read the document below carefully to see if we are right for you.  The agreement below is effective upon creation of an account with Zirux Gaming or when payment is received for any ordered service. 
 

Refunds
We do not offer refunds, we offer free trials for 3 days without cost to you. We advise you to take advantage of this Free Trial before you purchase a service.

Disputes

If you dispute any charges with Paypal, your service will be suspended until it is resolved.
Any and All disputes will be dealt with through Support Tickets.

Terms for 3 Day Free Trials: 
Customers are allowed to add one free trial at a time on their account. Current customers can also add a Trial Server to their account without any penalties. Customers are required to keep the server branded.  The free system is in place to allow a trial to any customer wanting to run a rented server for a new game.  If it even remotely looks like the system is being abused by a anyone in any way, they will be banned. No questions asked.  
 
Zirux Gaming cannot be held responsible for any type of file changes that reverts the site to an unusable state.  If the customer cannot state what file was changed, the location of the changed file, and the problem cannot be fixed the site may need to be reloaded, installing all original files for the site.  A fee of $5.00 may be charged if the site needs to be reloaded. 
 
All support issues must be submitted through the creation of a support ticket to the appropriate department using the integrated client area. 
 
Clan pay/Group Pay

All payments sent to Clan Pay accounts are 100% non refundable and are credited to the account holder only.  Paypal transaction fee's will apply to any payment sent through Clan Pay. Zirux Gaming waives any and all responsibility to the customers encrypted hash code on their website. If the customers hash code is compromised or modified on their personal website, Zirux Gaming will not be held responsible for the recovery of lost funds. It is of sole responsibility of the account owner and their website staff to insure the proper hash code on their website. Clan Pay is 100% optional for customers to use and in no way does Zirux Gaming force customers to use it. 
 
Payments/Paypal 
All payments are due before service is rendered. Service payments are expected on or before your next bill date. Requests to cancel your server can be made from the Members Area.

All payments sent to Zirux Gaming through Paypal are handled by Paypal and Zirux Gaming can not be held responsible for any loss of payment.  Paypal subscriptions are created by the client and not Zirux Gaming.  Therefore, Zrux Gaming is not responsible for any recurring payments made from a subscription payment while the user is a client of Zirux Gaming or after the client has left Zirux Gaming or closed their account. 
 
Servers 
Customers are responsible for the administration of their servers.  All game servers are to remain compliant with our Terms of Service at all times.  Password-protected servers may not be advertised to the general public. Your server will be shut down if it is found to be advertised to the public. 
 
We reserve the right to inspect any game server to make sure you haven't changed the settings to something you haven't paid for.  
 
FTP access is not to be used to run a file site or for file storage. All users are responsible for their files and the content of their servers. Game Server installs come as a basic setup. Additional files and add-ons must be applied through our panel or by the customer.   Please change your files with care. We are not responsible for the files in your game server directories after your game server account is activated.  
 
You MAY NOT advertise a Zirux Server as another companie's server! 
 
You may change, upgrade, or downgrade your service at any time. Additional fees may apply for service upgrades and a prorated fee will be charged if you are upgrading service in the middle of your current billing cycle.  
 
Content 
All information submitted to Zirux Gaming will stay at Zirux Gaming. We will NOT share your Information with anyone Else.  

Ziruxgaming.com servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademarks, trade secrets or other intellectual property rights used without proper authorization, material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. 
 
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of a copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. 

Zirux Gaming reserves the right to cancel, temporarily suspend or deny services to customers at our discretion. 
 
Content not allowed on any shared/reseller servers includes but is not limited to:

Abuse Towards Staff Members 
The staff at Zirux Gaming treats our customers with much respect and in return expects the same from our customers. If we feel that you are being disrespectful or demeaning to any staff members, your account may be suspended without refund.  This includes any and all advanced payments made as well. 
 
Server Abuse/Customer Abuse 
Any attempted attack against a Zirux Gaming server or customer being hosted by Zirux Gaming is strictly prohibited and will result in automatic termination of your account without refund including no refund for advanced payments. This includes any and all advanced payments made as well. 
 
Violating Our Policies 
Failure to comply with all current and future Terms of Service will result in termination of your account and/or service interruption. We will immediately terminate your server if we find it is in violation of our Terms of Service. The server will remain shutdown until the account holder ensures us his/her game server will comply with our Terms of Service. If a user has excessive violations, then his/her account will be terminated permanently without refund.  
 
The customer agrees to indemnify and hold harmless Zirux Gaming from any claim resulting from the use of our services.  By checking the box above you agree to release zirux.com, ziruxgaming.com, and ZMK LLC from all legal responsibilities.

We reserve the right to remove/suspend any account without notice.

These terms of service may change during the period of services offered, with Little or NO Warning/Notice to the customer.
